Furthermore, for the purpose of the present Terms of Use, wherever the context so requires “Applicant(s)” shall also mean individual(s) who have registered or created an account for themselves directly or indirectly to use the services of the Platform, for their own personal benefit and choice, under the head “For Security Engineers”, and “Hiring Manager(s)” shall also mean individual(s) who have registered or created an account for themselves directly or indirectly to use the services of the Platform for their own personal benefit and choice, under the head “For Hiring Managers”, as mentioned on the website respectively.

Hiring Managers Agreement

Hiring Managers understand and agree that the available profiles of Applicants are not a communication or advertisement to influence the User, for selection of any particular profile. It is the sole discretion of the Hiring Managers to select or not select any profile from the pool of Applicants. The term “We”, “Us”, “Our”, “Cyber Unbound”, “Company” shall mean Cyber Unbound. The present Terms of Use, including without limitation, the applicable policies which are incorporated herein by reference and which forms an integral part of these Terms of Use; govern your usage of the website. By accessing or using our website or availing our services, you signify that you have read, understood, and agree to abide and be bound by the present Terms of Use (“Agreement”).

Cyber Unbound's Right to Modify

Cyber Unbound at its sole discretion reserves the right to make unilateral modifications to the Terms of Use / Agreement without providing any prior notice or assigning any reason to you. Your continued usage of the website after any such changes constitutes your acceptance of the changes made to the Terms of Use / Agreement. Harmful or Offensive Content

The User shall not upload, post, transmit, publish, or distribute any material or information that is unlawful, or which may potentially be perceived as being harmful, threatening, abusive, harassing, defamatory, libelous, vulgar, obscene, or racially, ethnically, or otherwise objectionable.

Accuracy of Resume/Information

The User expressly states that the resume / insertion or information / data being fed into the network of Cyber Unbound by the User is correct and complete in all respects and does not contain any false, distorted, manipulated, fraudulent or misleading facts or averments. Cyber Unbound expressly disclaims any liability arising out of the said resume insertion / information / data so fed into the network of Cyber Unbound by the User. Further, the User agrees to indemnify Cyber Unbound for all losses incurred by Cyber Unbound due to any false, distorted, manipulated, defamatory, libelous, vulgar, obscene, fraudulent or misleading facts or otherwise objectionable content and averments made by the User on the network of Cyber Unbound.

Responsibility for Account Security

The User is solely responsible for maintaining confidentiality of the user password and user identification and all activities and transmission performed by the User through his user identification and shall be solely responsible for carrying out any online or off-line transaction involving credit cards / debit cards or such other forms of instruments or documents for making such transactions and Cyber Unbound assumes no responsibility or liability for their improper use of information relating to such usage of credit cards / debit cards used by the Subscriber / User online or off-line.

The User is solely responsible for obtaining, at his / her own cost and effort, all licenses, permits, consents, approvals and intellectual property or other rights as may be required by the User for using the Product(s) or Service(s), if need be.

THE USER REPRESENTS, WARRANTS AND COVENANTS THAT ITS USE OF CYBERUNBOUND.CO SHALL NOT BE DONE IN A MANNER SO AS TO:

• Access the Platform for purposes of extracting content to be used for training a machine learning or Artificial Intelligence model, without our express prior written permission.
• Violate any applicable local, provincial, state, national or international law, statute, ordinance, rule or regulation, including but not limited to the present Terms of Use;
• Interfere with or disrupt computer networks connected to Cyberunbound.co;
• Impersonate any other person or entity, or make any misrepresentation as to your employment by or affiliation with any other person or entity;
• Forge headers or in any manner manipulate personal identifiers in order to disguise the origin of any User information;
• Interfere with or disrupt the use of Cyberunbound.co by any other user, nor stalk, threaten, or in any manner harass another user;
• Use Cyberunbound.co in such a manner as to gain unauthorized entry or access to the computer systems of others;

• Constitute hosting, modifying, uploading, posting, transmitting, publishing, or distributing any material or information

For which you do not have all necessary rights, consent, permissions and licenses;

• Which infringes, violates, breaches or otherwise contravenes the rights of any third party, including any copyright, trademark, patent, rights of privacy or publicity or any other proprietary right;
• Which contains a computer virus, or other code, files or programs intending in any manner to disrupt or interfere with the functioning of Cyberunbound.co, or that of other computer systems;

The subscription to use the product(s) and service(s) of the website by a user shall be subject to Cyber Unbound’s discretion and the permissible limitations and authority as applicable and as advised.

Cyber Unbound shall not be liable for any loss or damage sustained by reason of any disclosure (inadvertent or otherwise) of any information concerning the User's account and / or information relating to or regarding online transactions using credit cards / debit cards and / or their verification process and particulars nor for any error, omission or inaccuracy with respect to any information so disclosed and used whether or not in pursuance of a legal process or otherwise.

Payments by the Hiring Managers for the service(s) offered by Cyberunbound.co shall be done on the basis of the contract / agreement executed between the parties. No Refund will be processed after the Applicants’ appointment has been finalised. Nonetheless, a request for a refund if raised by any Hiring Manager, the same will be at the sole discretion of Cyber Unbound. Cyber Unbound offers no guarantees whatsoever for the accuracy or timeliness of the refunds reaching the Customers card/bank accounts. Cyber Unbound gives no guarantees of server uptime or applications working properly. All is on a best effort basis and liability is limited to refund of amount only, subject to Cyber Unbound’s sole discretion. Cyber Unbound undertakes no liability for free services. Cyber Unbound reserves its right to amend / alter or change all or any disclaimers or terms of use or agreements at any point in time without any prior notice. All terms / disclaimers whether specifically mentioned or not shall be deemed to be included if any reference is made to them.

Unless otherwise specified and notwithstanding anything contained in any other agreement or arrangement, by whatever name called, the performance obligation of Cyber Unbound is to provide access of its on-line portal to the Users for the duration of the period of the Users subscription, account activity & reference to any usage, by whatever name called or any other performance obligation, if any, is to provide the upper limit for consumption, which by itself, does not create any additional performance obligation whatsoever upon Cyber Unbound.

Subscriber / User acknowledges and agrees that Cyber Unbound / Cyberunbound.co, at its sole discretion and without prejudice to other rights and remedies that it may have under the applicable laws, shall be entitled to set off the amount paid or payable by a Subscriber / User against any amount(s) payable by Subscriber / User to Cyber Unbound under any other agreement or commercial relationship towards other product(s) / service(s).

Cyber Unbound further reserves its right to post the data on the website Cyberunbound.co or on such other affiliated sites and publications as Cyber Unbound may deem fit and proper at no extra cost to the Subscriber / User.

The subscription or use of product(s) and service(s) to the and the present agreement between Cyber Unbound and the Subscriber / User is not a "non-poach agreement" nor can the same be termed or used as an alternative to "non-poach agreement" in as much as Cyber Unbound / Cyberunbound.co is a public site and all information posted by Cyber Unbound goes to the public domain except information / data which is specifically assigned to a non-public / private character.

Cyber Unbound has no agents and does not operate through any agents save for those specifically mentioned on the home page of the website.

ANY REFERENCE TO DUTIES AND TAXES ETC IN THESE TERMS OF USE SHALL INCLUDE GOODS AND SERVICES TAX (HEREIN REFERRED AS GST) FROM THE DATE GST LAW IS IMPLEMENTED IN INDIA. ADDITIONALLY, IN AN EVENT WHERE CYBER UNBOUND MAY BE PUT TO QUESTION OR IS SUBJECTED TO PENAL OR REMEDIAL LAWS FOR INFRINGEMENT OF RIGHTS BECAUSE OF THE ACTS OF OTHERS, WHERE OTHERS INCLUDE, WITHOUT LIMITATION, PARTNERS, USERS, 3RD PARTY SERVICE PROVIDERS, ADVERTISERS, AND/OR AFFILIATES HAVING CONNECTION WITH CYBER UNBOUND IN ANY CAPACITY WHATSOEVER OR NOT, IN THAT CASE USER ACCEPTS TO NOT HOLD CYBER UNBOUND LIABLE FOR ANY SUCH ACTS AND OMISSIONS, AND ALSO PROVIDES CONSENT TO INDEMNIFY CYBER UNBOUND FOR ANY AND ALL SUCH LOSS, COST, DAMAGES, LEGAL FEE CAUSED AND INCURRED WHILE DEFENDING, CONTESTING, REPRESENTING, ANSWERING ITSELF AS CYBER UNBOUND COMPLY WITH THE LAWS AND TAKE APPROPRIATE MEASURES, CAUSED DUE TO THE CONCERNED ACTS.

If any dispute arises between a User/Users and Cyber Unbound arising out of use of Cyberunbound.co or thereafter, in connection with the validity, interpretation, implementation or alleged breach of any provision of these Terms and Conditions, the dispute shall be referred to a sole arbitrator who shall be an independent and neutral third party identified by the Company. Decision of the arbitrator shall be final and binding on both the parties to the dispute. The place of arbitration shall be New Delhi, India. The Arbitration & Conciliation Act, 1996 as amended, shall govern the arbitration proceedings.

These Terms and Conditions shall be governed by the laws of Republic of India. The exclusive forum for any disputes arising out of or relating to these Terms of Use shall be a court of law located in New Delhi, India.

Furthermore, basis the service chosen on the website under a particular portal, the following specific conditions will apply without any demur to the same:

Applicants

• Applicants are obliged to keep their dashboard / profile information accurate & factual vis-a-vis their circumstances such as expected salary, calculated and determined based of their country of location, current skills and experience.
• Applicants must provide and mention true and precise skill set along with verified links to the updated Resume & Certifications.
• Applicants who are skilled in web penetration testing are required to constantly solve CTFs, which are regularly uploaded / updated by Cyber Unbound, to demonstrate their skills and maintain their presence on the website / platform and avoid removal from the portal.
• Applicants need to join Cyber Unbound’s community platform discord & engage actively to maintain their presence on the website / platform and avoid removal from the portal.
• Applicants who do not have an updated profile or profile with correct information will face removal of the account from platform.
• Applicants with fake profile will face removal of the account from platform and will be banned to use the product and services again indefinitely.

Hiring Manager

• Hiring Managers cannot contact Applicants outside the platform in any manner, whatsoever. The Applicants’ information is provided to give full transparency to Hiring Manager which should not be misused. Doing so can lead to getting banned from the platform for an indefinite period of time, and restoration will be subject to terms and conditions mentioned by Cyber Unbound.
